Terms and Conditions of Outdoor Activity Bookings – Diving and Mountaineering

By making a booking with Mark Lewis Adventures you agree to these terms and conditions without reservation. Our Terms and conditions are in line with the Consumer Contracts Regulations giving a 14-day cooling-off period post-booking. Further to that, all of our courses fall into the category of leisure activities under Part 3 of the regulations, section 28, sub paragraph 1h. Where leisure activities provided for a specific activity on a specific date are excluded from cancellations.

We are regulated by Technical Diving International, Scuba Diving International, British Sub Aqua Club, Association of Mountaineering Instructors, and the Mountain Training Association of UK.

GENERAL

  1. To secure a reservation for a course, trip, training or any service that Mark Lewis Adventures offers, a booking form or email must be returned.
  2. Whole boat bookings, whole course bookings, multi-space bookings for trips are the responsibility of the person booking to fill any spaces. If the space is booked, then the person who booked it is responsible for filling it and paying for it.
  3. Once past the 14-day dead line the person who booked a space or spaces will be responsible for the full amount for the spaces booked, without exception.
  4. We have the right to fill any spaces available on any course, trip, training or service that we offer unless the person booking has booked all of the spaces.
  5. We strongly recommend that you take out insurance for your course, trip, training or service that we offer.
  6. We only charge you for what you book. We do not offer accommodation, transportation, flights, or any other deal that may be construed as a package.
  7. All overseas bookings are for services provided overseas and delivered overseas.

Ice Diving Courses

We aim to provide all ice diving courses when there is ice on the water. If there is no ice on the water due to weather conditions, we will still run the course but offer it as an altitude diving course instead. We don’t cancel the courses due to no ice as it isn’t cost effective and we have incurred costs to be onsite. Therefore, please ensure that you have adequate insurance in place to cover any loses that you may ensure if you decide not to go ahead with the course. Ice diving courses are booked for specific dates so our courses fall into the category of leisure activities under Part 3 of the Consumer Contracts Regulations, section 28, sub paragraph 1h. Where leisure activities provided for a specific activity on a specific date are excluded from cancellations.

Technical Diving Courses

On all diving courses that use gases other than air (so Nitrox and helium etc) then the student on the course, or the students on the course, are jointly and individually liable for the instructors gas bill. Typically on an Deco Course, the costs would be about £40/day. On a Trimix course, this could be over £100 per day. Technical diving courses are booked for specific dates so our courses fall into the category of leisure activities under Part 3 of the Consumer Contracts Regulations, section 28, sub paragraph 1h. Where leisure activities provided for a specific activity on a specific date are excluded from cancellations.

Challenge Events

  1. The Charitable organisation retains ownership of the event
  2. Mark Lewis Adventures does not get involved with any fundraising or collection of monies from participants.
  3. Mark Lewis Adventures provides fully insured and qualified activity leaders to lead you on each mountain or activity.
  4. Mark Lewis Adventures has the right to remove anyone from the event or cancel the event at any time on the basis of safety.
  5. Minimum of 15 participants at the agreed rate per participant.
  6. Mark Lewis Adventures provides mountain safety and risk management only for the event. Transportation, promotions, accommodations etc are arranged by the charitable organisation at their expense.

PAYMENTS

  1. All payments are non-refundable as per Consumer Contracts Regulations giving a 14-day cooling-off period post-booking.
  2. The balance is due no later than 4 weeks prior to the start date of your course, trip, training, activity or service booked.

CANCELLATIONS

Your payments are non-refundable unless either of the following happen;

  1. We cancel the course / trip due to any reason.
  2. Cancellation by you within fourteen (14) days of booking your course.

We strongly suggest you take out cancellation insurance.
